SENATOR COMRIE BACKS LEGISLATION TO PROTECT NEW YORKERS FROM UNFAIR BUSINESS PRACTICES

Queens, NY — Senator Leroy Comrie is proud to sponsor the FAIR Business Practices Act legislation introduced by Attorney General Letitia James aimed at modernizing New York’s consumer protection laws and holding bad business actors accountable. 

The bill would update a law that hasn’t been meaningfully changed in over 37 years. It gives the Attorney General’s office and everyday New Yorkers more tools to stop companies from using misleading, abusive, or flat-out unfair business tactics, like hidden junk fees, scams that target non-English speakers, or shady subscription models that are nearly impossible to cancel. 

“The laws on the books haven’t kept up with how business is done today,” said Senator Comrie. “New Yorkers deserve clear protections and the ability to get relief when they’ve been taken advantage of. This bill brings us in line with nearly every other state and gives people the power to get restitution.”

Attorney General Letitia James Introduced Legislation

The legislation expands the scope of New York’s General Business Law §349 by
  • Allowing victims to take civil action against unfair, abusive and deceptive business practices
  • Raising penalties up to $1,000 per violation
  • Supporting small businesses that often fall victim to misleading contracts and aggressive lenders
  • Protecting seniors, immigrants, veterans, and other vulnerable New Yorkers

Examples of practices this bill would address include: 

  • Loan servicers steering borrowers into more expensive plans 
  • Health insurance companies advertising “in-network” doctors who don’t accept the plan 
  • Debt collectors wrongfully seizing Social Security checks 
  • Companies hiding key pricing or policy information in fine print 

This bill is about fairness. It’s about catching up to the times, protecting our communities, and making sure nobody gets left behind,” Comrie said. “We need to make it clear that in New York, there are rules and if you break them, there are consequences.”
